The Legal Framework of Global Trade

In the complex and international world of cargo transport, infrastructure and fleets alone are not enough; international laws and regulations play a vital role in facilitating, standardizing, and securing the movement of goods. Therefore, a thorough understanding of conventions, regulations, and international organizations such as UNCTAD, the CMR Convention, Incoterms, and instruments related to specialized bodies like ICAO, IMO, and IRU is essential for every professional in the logistics sector.


What is UNCTAD?

UNCTAD stands for the United Nations Conference on Trade and Development. It is a key institution in establishing principles of international trade, promoting sustainable transport, and supporting developing countries in the process of economic globalization. UNCTAD significantly contributes to drafting recommendations, studies, and legal instruments in the field of international transport and trade law.


Key Regulations in International Transport

1. Incoterms

Standardized rules defining the responsibilities of sellers and buyers regarding transport, insurance, costs, and risks in international transactions. They are issued by the International Chamber of Commerce (ICC). The latest edition is Incoterms 2020.


2. CMR Convention

The international convention governing cross-border road transport. It regulates the conditions of the consignment note, carrier liability, damages, delays, and the rights of consignees.


3. Maritime Transport Conventions

  • Hague–Visby Rules
  • Hamburg Rules
  • Rotterdam Rules

These frameworks define the responsibilities of sea carriers, time limits for claims, and compensation for cargo damage.


4. Warsaw and Montreal Conventions (Air Transport)

These conventions provide the legal framework for international air transport, covering air waybills, airline liability, and compensation for damages.


5. TIR Convention

Designed for international road transit of goods across multiple countries. Using a TIR Carnet allows border crossings without paying customs duties at each border. The International Road Transport Union (IRU) supervises its implementation.


6. COTIF Convention

Governing international rail transport. The Intergovernmental Organisation for International Carriage by Rail (OTIF) is responsible for these regulations, enabling member states to operate integrated rail transport.


Role of International Organizations

  • IMO: International Maritime Organization – sets safety and environmental standards, including SOLAS and MARPOL conventions.
  • ICAO: International Civil Aviation Organization – establishes international air transport standards.
  • IRU: International Road Transport Union – manages TIR documents and sets road transport standards.
  • UNCITRAL: United Nations Commission on International Trade Law – develops uniform trade law, including the Convention on Contracts for the International Sale of Goods (CISG).
